Why Use A Solicitor?

If you are experiencing legal troubles then you will be left wondering how to find a solicitor and how they can actually help you. Solicitors Brighton are designed so that they can fight your case regardless of what sector or section or the law it comes under. For example, there are lawyers who specialize in injury claims and then there are those who are more to do with property and even tourism etc… The fact is that many law firms have now tool the approach of hiring a number a lawyers who specialize in different fields so as to give their firm a broader view and their client’s a more complete service.

You used to go to one law firm is you had an issue regarding housing and then another one if, in the future, you had a problem with an injury or a compensation claim however many law firms now employ solicitors who are different in terms of what they specialize in so if you are happy with the service at that particular law firm there is no need to go elsewhere if you need legal advice regarding an issue that is totally different from your first one and is, indeed, in a different section of the law.

What you need to remember about choosing a solicitor is the way the two of you interact. This is the person that could be the deciding factor between you winning your claim or losing it so it is important that you get on well with the solicitor (in a professional sense) and this will help you greatly when it comes to arguing your case. Indeed, as long as your trust each other when it comes to carrying out tasks and giving details then you will be in very strong standing when it comes to your case.

The Details Of Personal Injury Compensation Claims

Regardless of how careful you happen to be, accidents do occur, and it's pretty difficult to avoid them altogether. Every day accidents happen and people are seriously injured; just look at how common car wrecks are. Really anything could happen and leave someone injured. While insurance providers may provide coverage for these types of personal injury claims, you certainly can't expect to receive the maximum possible compensation for your injury, as they tend to only pay the bare minimum that is required of them. This makes obtaining a professional legal attorney during the injury claim process a necessity.

Every personal injury case is specific and personal, and it's important to have a specialized law professional that understands the various workings of these insurance companies and how they seek to provide their clients with the minimum possible compensation payments that they can. Specific personal injury claims, such as whiplash claims, will typically involve dealing with other payments besides the usual medical expenses; the time that you lose from the injury and recovery process, as well as the wages that you are losing are typically not compensated for by most insurance companies.

Insurance adjusters want to see that you are settling for the absolute minimum, such as the medical expenses involved in the injury - this is considered a great victory for most insurance companies. Specialized law experts understand this, and want to ensure that you are getting every penny that you deserve in the process. Never settle for the small deals that the insurance company will attempt to make with you - in most cases you will be completely capable of receiving much more compensation for your specific case, you just need to know how to get it, and have the proper legal help to aid you in achieving that goal.

Personal Injury Solicitors

Being the victim of any sort of injury is bad enough however why should you have to suffer unduly and, more often than not, suffer financially as well through loss of earnings or inability to work because you have suffered a physical impairment or psychological trauma?

A personal injury is quite a board term; it can be an accident that you have suffered in the workplace, an injury endured during a criminal assault or, indeed, something that has happened on holiday. These are just 3 different types of personal injury and there are many more that come under this umbrella term. However, an injury of this nature does not mean that you won’t be able to claim or be compensated for it and thousands every year are able to receive compensation to cover the stress of an accident as well as to make up for any loss in earnings because they cannot work as a result.

Alexander Harris Solicitors specialize in these types of injuries and can help you seek proper compensation for your trauma. Indeed, you will find that many personal injury victim’s are exempt from having to pay legal fee’s (such as a fee to the solicitor for taking on the case or for court costs) as public funding (formally called and referred to as legal aid) is often available for those that meet the certain financial criteria. In addition, Alexander Harris Solicitors can also work on a ‘no win no fee’ basis whereby if your compensation claim fails to succeed then you will not be eligible to pay any costs. In this case a ‘success fee’ will be agreed upon between the client and their solicitor before they officially take on the case and this will only be paid should the claim be successful and the client receives the money.

Employers Must Understand The Exempt vs. Non-Exempt Difference

Deciding which of your employee’s is exempt and which of them are non-exempt is something that a lot of businesses and companies find difficult. What constitutes an exempt employee? That is, an employee that, according to the Federal Labor Standards Act (FLSA) is not liable to receive either the basic minimum wage or any overtime pay for hours worked after the 40 hour working week limit. It really comes down to the physical responsibilities that you do around the workplace and not, as many businesses assume, your actual job title and position within the company as a whole.

The exempt vs. non-exempt debate rages on but if you, as an employer, fail to properly adhere to the rules around it then you could find yourself in some legal difficulty. The non-exempt workers are those that you do have to pay overtime money and at least the minimum wage however, again, it all comes down to their actual responsibilities within the business and not their titles. Many executive positions are considered exempt from the FLSA regulations if they consistently use independent judgment; the same goes for learned professionals who must earn over $455 per week and have a prolonged education in a specialized field and have acquired this through a extended period of, what the FLSA defines as, specialized intellectual instruction.

The intricate details of the law in this regard can be quite confusing and perplexing to the average employer and it is always worth getting adequate and informative legal advice so that you don’t breach any of the FLSA regulations. Many employees have successfully proved in the courts that they should have been considered non-exempt when in fact their employers had them to be exempt workers; getting the right legal advice could be paramount in regard to the exempt vs. non-exempt debate and save you a lot of legal expenses and aggravation in the future.

Groundbreaking Judgement On Live Football

A legal precedent has been set by the European Court of Justice in relation to the way in which live football in the United Kingdom is shown. Karen Murphy, owner of the Red, White and Blue pub in Portsmouth, has successful brought the issue in front of the ECJ.

Before this case was brought to the courts’ attention it was assumed that live coverage of the English Premier League had to be played through domestic (British) TV services such as Sky, however the European Court of Justice ruled that this directly contravenes EU law and that satellite decoders bought from anywhere within the EU should be legally allowed to show football on TV.

This has been a slight legal grey area in recent years as Sky have previously claimed that any live Premiership games have to be played through their system however many bars have taken upon themselves to install foreign satellite decoders and have shown these games through this equipment; Murphy was one of these landlords. What this ruling means is that, theoretically, there should be no law stopping the continued use of these foreign satellite receivers in the home (however the issue of ‘public showings’ is still contentious) which can be cheaper than using Sky’s own equipment.

BSkyB however are expected to appeal this ruling and challenge all the way however for those who watch these games in their own home it may not make much of a difference as the legal precedent set by the ECJ now states that the prohibited use of these foreign satellite decoders cannot be justified within the EU and EU law has now declared them legal to use.
