U.S. Health Care Reform Law Challenged By 21 States

Lt. Governor Peter Kinder has been joined by 21 states in a constitutional challenge against the the federal health care reform law. Earlier this week a brief was filed in the U.S. Court of Appeals for the 8th Circuit Court. In the brief, 21 state attorney generals voice their support of Kinder's claims that an "individual mandate" included in the health care law is unconstitutional.

The brief was filed by former U.S. Solicitor General Paul Clement who is representing the states. The mandate that requires American's to either buy health insurance or be subject to pay a fine by 2014 is unprecedented. If the law is allowed to stand it will be the first time in the history of the United States that Congress has made it a law that people will have to purchase a product as a condition of living in America.

Currently the lawsuit that was filed last July is on appeal. Kinder's spokesman, Jay Eastlick says that they are hopeful that the brief will urge the court to rule on the subject. Although it is unknown when the court will hand down a decision, the Department of Justice has until August 11 to file a reply.

In spring of last year Kinder started "Health Care In Action, Inc.," which is a fund that will finance his lawsuit. Kinder had later announced that he would be releasing a list of anyone who had donated to the fund, but that has still not been done. Democrats are questioning whether official resources should be used to promote the lawsuit when no donors have been named.

“This is very significant and welcome support of our challenge to the federal health care law,” said Lt. Governor Kinder. “This support also illustrates the broad consensus that Congress overstepped its constitutional authority when it passed this law forcing individuals to buy a specific insurance policy designed by federal bureaucrats.”
