Groundbreaking Judgement On Live Football
A legal precedent has been set by the European Court of Justice in relation to the way in which live football in the United Kingdom is shown. Karen Murphy, owner of the Red, White and Blue pub in Portsmouth, has successful brought the issue in front of the ECJ.Before this case was brought to the courts’ attention it was assumed that live coverage of the English Premier League had to be played through domestic (British) TV services such as Sky, however the European Court of Justice ruled that this directly contravenes EU law and that satellite decoders bought from anywhere within the EU should be legally allowed to show football on TV.
This has been a slight legal grey area in recent years as Sky have previously claimed that any live Premiership games have to be played through their system however many bars have taken upon themselves to install foreign satellite decoders and have shown these games through this equipment; Murphy was one of these landlords. What this ruling means is that, theoretically, there should be no law stopping the continued use of these foreign satellite receivers in the home (however the issue of ‘public showings’ is still contentious) which can be cheaper than using Sky’s own equipment.
BSkyB however are expected to appeal this ruling and challenge all the way however for those who watch these games in their own home it may not make much of a difference as the legal precedent set by the ECJ now states that the prohibited use of these foreign satellite decoders cannot be justified within the EU and EU law has now declared them legal to use.
