Class Action Suit Filed Against DHS

A class action lawsuit against the Department of Homeland Security was filed in an Illinois last week. The suit, filed by the Heartland Alliance's National Immigrant Justice Center, an immigrant advocate group, challenges the constitutionality of detainers. Local authorities have been instructed to detain anyone that is suspected of violating immigration laws even when there is no other basis for detainment.

Individuals that are suspected of violating immigration laws are held in custody until officers from the U.S. Immigration and Customs Enforcement arrive to take individuals into custody. The suit alleges that local authorities are violating the Fourth and Fifth Constitutional Amendments by issuing detainers. It also alleges that detainers violate the 10th Amendment because they force local and state governments to implement a federal law.

Jose Jimenez Moreno, one plaintiff included in the case is being held on other charges in Illinois. Even though Moreno is a U.S. citizen, a detainer was issued that prevents him from getting out of jail on bail. Immigration and Customs Enforcement issued the detainer in March of this year. Because he is a citizen of the United States, the detainer is invalid and violates his constitutional rights.

The group claims that the Department of Homeland Security ”fails to establish probable cause before issuing the detainers, does not notify individuals that detainers have been issued against them, and provides no means by which individuals can challenge their extended detention.” A spokesperson for the Department of Homeland Security did not respond to a request for comment.
