The pharmaceutical industry makes billions a dollar a years as a result of selling medications to the elderly. In fact, older patients make up the vast majority of those that regularly fill prescriptions. Although most elderly patients take medicines which help them to manage serious illnesses, there is a financial benefit for doctors to write more prescriptions than is necessary. Pharmaceutical companies offer free samples of their new medicines to physicians and patients on a regular basis. Some of these medicines are released to the general public before substantial testing has been conducted. Of course, the US Food and Drug Administration requires pharmaceuticals to be approved before they can be sold, but sometimes drug companies will hide or alter the results of studies in order to expedite the approval process.When multiple deaths or serious injuries occur as a direct result of medications taken by the elderly a federal panel convenes to investigate the matter. Their medical records will be subpoenaed and the doctors that prescribed the medications. If federal investigators are unable to come to a conclusion then the pharmaceutical companies themselves will be scrutinized. When a batch of medicine is tainted or found to cause serious bodily industry, then pharmaceutical companies will issue a recall.
Elder law attorneys are responsible for investigating medical claims involving elderly patients who are misdiagnosed, and ultimately, given the wrong medication. Prescribing the wrong medical can have disastrous results, especially when an elderly patient that is suffering from a number of illnesses is involved. Sometimes this can happen inside of nursing homes when health care attendants accidentally disperse the wrong medicines to the wrong patients. Other times physicians themselves can be at fault if they hastily make a diagnosis instead of ordering additional testing or asking for a second opinion.
In hospitals, older patients may be at risk if adequate safety precautions are not taken. This can include employee screening, security or even the proper servicing of medical equipment. Deaths that occur in hospitals are nearly never questioned because it is assumed that everything was done to both care for as well as treat all patients. In some extreme cases elder abuse takes place in highly regarded health care facilities. The only way for the families of injured or deceased elderly patients to find out if their relatives were mistreated is to hire an elder law attorney. Once the medical records are reviewed by a medical expert that is not affiliated with the health care facility being investigated an elder care attorney will be able to deduce whether or not any wrongdoing took place. These investigations can be difficult to complete if complete medical records are not available but an elder law attorney will be able to subpoena files and interview all parties involved in the case.
